SpellingandVocab.com is operated by Komodo Learning Ltd, a company registered in the United Kingdom (company number INI 618190) with its registered office at 109–113 Royal Avenue, Belfast BT1 1FF, UK (“Komodo,” “we,” “us,” or “our”).

These Terms govern your access to and use of SpellingandVocab.com and related services (the “Service”).

By creating an account or using the Service, you agree to these Terms.

If you use the Service on behalf of a school or institution, you confirm that you have authority to bind that organization.

1. Description of the Service

SpellingandVocab is an educational platform designed for:

  • US Grades 1–10
  • UK Years 1–10

The Service provides:

  • Spelling practice
  • Vocabulary learning
  • Pronunciation exercises
  • Writing exercises
  • AI-assisted feedback
  • Teacher-created lessons via uploaded word lists
  • Student progress tracking

The Service is intended solely for educational use.

2. Accounts

2.1 Teacher Accounts

Teacher accounts may be created only by adults using the Service for educational purposes.

Teachers may:

  • Create classes for your school
  • Upload word lists
  • Assign lessons
  • Review AI-generated feedback
  • Track student performance

Teachers are responsible for reviewing AI feedback before relying on it for grading.

2.2 Student Accounts

Students may access the Service only:

  • Through invitation or authorization by a teacher
  • For educational purposes

Students may not create teacher accounts.

3. Single Sign-On (Google and Microsoft)

You may log in using Google Sign-In or Microsoft Single Sign-On.

By doing so, you authorize us to receive basic profile information (such as name and email address) for authentication purposes.

We use SSO data solely to:

  • Authenticate users
  • Manage accounts
  • Provide the Service

We do not sell SSO data or use it for advertising.

Your use of Google or Microsoft remains subject to their respective terms and privacy policies.

4. Optional and Trial Features

We may from time to time introduce new features, tools, or functionality, including enhanced or advanced pronunciation evaluation features (collectively, “Optional Features”).

Optional Features:

  • May be offered on a trial, beta, limited, or invitation-only basis;
  • May be available only to certain users, subscription tiers, or accounts;
  • May be modified, suspended, restricted, or discontinued at any time;
  • May later become subject to additional fees or subscription requirements.

We do not guarantee the continued availability, accuracy, performance, or functionality of any Optional Feature.

Participation in any trial or beta feature is voluntary and may be subject to additional terms or usage limits.

5. Subscriptions and Payment

5.1 Pro Subscription

Teachers may subscribe to a paid Pro version.

Subscription details are provided at checkout.

Subscriptions renew automatically unless cancelled.

You may cancel at any time through your account settings.

Unless required by law, subscription fees are non-refundable.

5.2 Stripe Payments

Payments are processed by Stripe, Inc.

By purchasing a subscription, you agree to Stripe’s terms and authorize Stripe to charge your payment method.

We do not store full card numbers.

5.3 Basic Plan Limitations

Under the Basic Plan:

  • Teachers may create or access up to 20 unique lessons.
  • This includes deleted lessons.
  • Creating multiple accounts or attempting to bypass limits is prohibited.

6. Educational and Fair Use Restrictions

The Service is intended solely for legitimate educational use within a classroom, school, or structured learning environment.

You may not use the Service:

  • For unauthorized commercial tutoring businesses;
  • To resell access to lessons or materials;
  • To share classes to students enrolled across more than one school;
  • To create derivative educational content for commercial resale;
  • To generate revenue unrelated to direct educational instruction;
  • To promote, market, or advertise classes, courses, or educational services to the general public;
  • To use the Service as part of a content marketing strategy, lead generation activity, or personal brand promotion;
  • To enrol or invite members of the public into classes for non-educational or promotional purposes;
  • For any non-educational commercial activity.

Use of the Service must be limited to bona fide instructional activities involving enrolled students under the supervision of a teacher or educational institution.

We reserve the right to suspend or terminate accounts engaged in unauthorized commercial, promotional, or marketing activities.

7. AI-Generated Content and Evaluation

7.1 AI-Assisted Lessons

Some content may be created or enhanced using AI systems.

AI-generated content may contain inaccuracies.

Teachers are responsible for reviewing materials before assigning them.

7.2 AI Writing and Pronunciation Evaluation

The Service uses third-party AI APIs to evaluate writing and pronunciation.

You acknowledge:

  • AI output is automated and probabilistic.
  • Feedback may not always be accurate or unbiased.
  • Teachers remain responsible for final grading decisions.
  • AI processing is further described in our Privacy Policy.

8. User Content

Teachers retain ownership of uploaded word lists.

You grant Komodo a limited license to host and process content solely to operate the Service.

You represent that uploaded content:

  • Does not infringe third-party rights
  • Is appropriate for school-aged learners

9. Content Standards

The Service may include teacher-uploaded or AI-generated materials.

We do not guarantee all content will be free from inaccuracies or material some users may find objectionable.

We may remove content at our discretion.

10. Student Submissions and Classroom Conduct

The Service allows students to submit written responses, including sentences illustrating word usage that are free-text content (“Student Submissions”).

By using the Service, you acknowledge and agree that:

  • Student Submissions are created by individual students and do not represent the views of Komodo Learning Ltd.
  • Komodo does not pre-screen, monitor, or control Student Submissions.

Teachers and educational institutions are solely responsible for:

  • Reviewing Student Submissions
  • Monitoring student conduct
  • Determining whether any content is inappropriate
  • Applying disciplinary policies where necessary

Komodo shall not be responsible or liable for:

  • The content of Student Submissions
  • Any offense caused by Student Submissions
  • Any disciplinary action taken by a school or teacher
  • Any consequences arising from a student’s written content

We reserve the right, but not the obligation, to remove or restrict access to Student Submissions that:

  • Violate these Terms
  • Are unlawful
  • Are abusive, threatening, obscene, discriminatory, or otherwise inappropriate

Use of the Service does not limit or replace a school’s authority to enforce its own classroom rules and behavioural policies.

11. Privacy

Our collection and use of personal data is governed by our Privacy Policy.

12. Disclaimer of Warranties

The Service is provided “as is” and “as available.”

We do not guarantee:

  • Uninterrupted availability
  • Error-free operation
  • Accuracy of AI-generated feedback
  • Alignment with specific curriculum standards

Educational decisions remain the responsibility of teachers and schools.

13. Limitation of Liability

To the maximum extent permitted by law:

  • Komodo Learning Ltd shall not be liable for indirect or consequential damages.
  • Total liability shall not exceed:
    • The amount paid in the prior 12 months; or
    • £50 GBP (or equivalent USD), whichever is greater.

Nothing limits liability where prohibited by law.

14. Termination

We may suspend or terminate accounts for:

  • Violations of these Terms
  • Circumvention of usage limits
  • Unauthorized commercial use

You may terminate your account at any time.

15. Dormant and Inactive Accounts

We reserve the right to deactivate or delete Basic (free) accounts that have remained inactive for a continuous period of twelve (12) months.

For the purposes of this section, an account may be considered inactive if there has been no login activity or meaningful use of the Service during that period.

Where reasonably practicable, we may provide notice to the account holder prior to deletion. However, we are not obligated to provide such notice.

Upon deletion of a dormant account:

  • Access to the account will be permanently disabled.
  • Associated content and data may be deleted in accordance with our Privacy Policy.
  • We shall not be liable for any loss of data resulting from such deletion.

This provision does not apply to active paid subscriptions unless otherwise specified.

16. Governing Law

These Terms are governed by the laws of Northern Ireland, UK.

Nothing limits mandatory rights under applicable U.S. law.
